ADVICE TO BUYERS
Goffs advise potential purchasers to read the Goffs Conditions Of Sale (General) or the Goffs Conditions of Sale (Kempton) before bidding. The Conditions Of Sale are designed to protect the rights of both vendor and purchaser whilst ensuring that Goffs auctions are fair to both parties. They set out the legal basis under which Goffs Bloodstock Sales auctions are conducted.
In addition to the Terms and conditions of Sales, Goffs offer the following advice:
• Goffs strongly recommend that purchasers use a professional adviser.
• Goffs strongly recommend that purchasers inspect the horse before bidding.
• There is a tradition at bloodstock auctions worldwide for a vendor to offer ‘luck money’ to a purchaser after the sale. This is solely a voluntary matter for the vendor and is not governed by the Conditions of Sale. Under no circumstances should purchasers enter into arrangements of this nature prior to the sale. If a post sale agreement should be made, it should be disclosed to all parties involved in the sale, including owners not present on the day of sale.
• “Auction Rings”
An “auction ring” is created where “dealers” agree not to bid against one another and hold a second auction privately after the public auction has been completed. It is not considered that there has been any attempt by purchasers to operate together on an auction ring basis at Goffs but anyone suspecting that this situation is occurring should notify a Goffs Director.
• Auction is a Free Public Market
Vendors and Purchasers should be free to conduct their business at Goffs without interference or intimidation in any form by third parties. A Vendor or Purchaser should be free to do entirely as he wishes in respect of selling or purchasing a horse at our Sales and any Vendor or Purchaser who experiences such interference, coercion or intimidation in the course of his business should immediately inform a Director of Goffs.
• Members of Goffs staff are available at all times to assist, should you have any queries concerning our sales.
VAT
In accordance with current legislation ‘Flat Rate’ V.A.T. is chargeable on all bloodstock sales.
EXEMPTION CERTIFICATES
Veterinary Examination of horses arriving in Great Britain by sea from Ireland. All horses arriving in Great Britain by sea from Ireland are now subject to veterinary examination at the port of entry. However, arrangements have been made whereby horses bought at these sales are exempted from such examination if a certificate declaring this fact is produced. Buyers wishing to obtain exemption certificates are asked to apply at the Auctioneer's Office as soon as possible after the time of purchase.
SALES WITH ENGAGEMENTS
The attention of both sellers and buyers is drawn to Rule 91 (Irish Rules of Racing). In effect, the seller is liable for entry fee and forfeits incurred until the date of sale and the buyer becomes liable for expenses after the date of sale until he strikes the horse out of its engagements or re-sells. There Is no need for a Transfer of Engagements form to be completed as the Auctioneers will inform Horse Racing Ireland of transactions that take place at the Sales, and their certificate will be accepted as proof that horses have changed ownership. Engagements are given in the Catalogue, Supplement to the Catalogue or are announced at time of sale and the buyers should acquaint themselves with what engagements, if any, their purchases hold and should remember that they are liable for any forfeits incurred from the fall of the hammer until they strike out
V.S. CERTIFICATE RE-EXAMINATION
Buyers of Lots offered with V.S. Certificates (other than those offered for Sale with a Pre-Sale Veterinary Certificate) may have their purchases re examined by a member of the Panel of Veterinary Surgeons if the Auctioneers are notified within 60 minutes of the time of purchase (30 minutes in the case of the last 15 Lots each day). Vendors (or their agents) must be prepared to take their charges up to the Veterinary Examination Paddock within that time and should not leave the vicinity of their boxes until it is known whether or not their animals are required for re-examination. They should not leave the Sales Paddocks until the results of such re-examination are known.
NAMES OF HORSES
Buyers of horses with names are reminded that although those names may be registered with Weatherbys under English Rules of Racing, the names have to be re-registered with Horse Racing Ireland before such horses can run in Ireland. There may be special requirements for horses foaled in countries other than Ireland and England and purchasers should acquaint themselves with any such special conditions.
FOAL IDENTITY & VACCINATION CERTIFICATES
Foal Identity & Vaccination Certificates will be forwarded to purchasers as soon as their accounts have been paid in full. It is the responsibility of Purchasers to check that the necessary innoculations have been carried out in accordance with the directives laid down by the relevant racing authority.
AGENTS
We wish to point out to you, in your own interest, the position of a bidder at auction who purchases on behalf of another party. When this bidder discloses his principal after purchases, we stress that there is no obligation on our part to automatically send the account to this principal. The person purchasing the horse in the sale ring remains liable for payment under the Conditions of Sale. If the account is sent to the principal, who defaults, then responsibility for payment remains with the letter of authorisation signed by the principal, addressed to Robert J. Goff & Co. plc. or any of its subsidiaries, which states that the said agent is authorised to purchase at a particular sale for the principal’s account, and that such principal has complied in advance with all the provisions required for purchasers at Goffs Sales.
VETERINARY SURGEONS
Intending purchasers who retain Veterinary Surgeons to examine Lots on their behalf prior to purchase, are requested to instruct the Surgeon of their choice to identify himself and the Principal on whose behalf he is acting if asked to do so by the Vendor of any Lot he wishes to examine.
VACCINATIONS
Details of mares which have been vaccinated against Virus Abortion will be available in the sales office. It is the responsibility of intending purchasers to check the vaccination status of mares in advance and to satisfy themselves that they meet their own requirements. All mares returning from the sales should be isolated from in-foal mares.
CREDIT FACILITIES
Purchasers are required to advise the Company of their credit requirements by forwarding a completed credit application form (see over) to arrive at Goffs not later than fourteen days prior to the Sale. As an alternative the establishment of credit facilities with the Company's Bankers will be acceptable:-

Where credit applications have been approved by the Company and the Purchaser notified accordingly, total purchases must be paid to the Company within 15 days from the last day of the Sale.
In all other cases the Company will insist on payment immediately after a Lot is knocked down, in Cash, Banker's Draft or Letter of Credit (see below).
Purchasers are cautioned that approval of credit for prior Sales does not establish credit for purchases at this Sale. To avoid misunderstanding, clients must re-establish credit before bidding.

Opened by your bank and confirmed through Bank of Ireland, Naas, Co. Kildare, Ireland, and provide for payment upon presentation of sight drafts accompanied by:
(1) Photocopy of Acknowledgement of Purchase

Expiration should be, at least, not less than forty five days from the last day of sale with partial drawings provided for.
